With regard to rules and regulations around Covid-19 is this page available. Although we have attempted to provide a good representation of the situation here, the indications of the (local) government remain indicative at all times. These can change regularly, so be well informed.

General conditions Los-Olivos, Partida Lleus 9D, 03720 Benissa

General

These are the conditions pertaining to the lease between the owner and the tenant. The owner is also referred to hereinafter as “we” and “us”.

The tenant is the person who signs the booking form or, in the case of online booking, the person who takes care of the online payment. This person is responsible for ensuring that all members belonging to the group adhere to these terms and conditions. The tenant is also called “you”.

The location that is meant here is Los-Olivos, Partida del Lleus 9D, 03720 Benissa

Bookings

The deposit for a booking must be paid within 7 days of the provisional booking in the manner indicated by the landlord. The booking is initially a preliminary reservation of 1 or more apartments until the deposit has been made and confirmed by us. Until then, the booking can be canceled at any time by tenant or owner without prior notice.

The rental amount, together with the deposit of €250, is due no later than 8 weeks before the start of the holiday. Failure to pay in full before/on the due date means cancellation of the renter's holiday without the right to a refund of the deposit. So schedule these due date(s) to ensure that payment is made on time.

Bookings less than 8 weeks before the arrival date must be paid in full at the time of booking.

Cancellation by the tenant

Cancellation of the booking by the tenant must be submitted in writing and addressed to info @los-olivos. Com.

Costs for the tenant due to cancellation:

from 8 weeks before arrival of 25% of the rent

from 4 weeks before arrival of 50% of the rent

from 2 weeks before arrival of 100% of the rent

Request a confirmation if you want to inform your cancellation insurer.

Cancellation by the owner

The owner will endeavor to ensure that the rented accommodation is available on the date booked. In the unlikely event that the rented property is not available, the owner has the right to cancel the reservation. The owner will try to find suitable alternative accommodation for the tenant. If suitable alternative accommodation is not found, the tenant is entitled to a full refund of the rent. The owner is only obliged to refund the money received from the tenant. No compensation or consequential damage is compensated.

Cancellation in connection with Covid-19

When traveling between the country of origin and Los-Olivos is made impossible by a general travel ban (code red), cancellation or rescheduling is possible free of charge. This emphatically does not relate to personal circumstances, such as a positive Covid test or quarantine obligation in connection with an infection. 

Miscellaneous

Although a true and accurate description of the rented property has been provided, changes may have been made to the rented property over time. The tenant accepts that no compensation is paid for such differences.

The owner reserves the right to enter the rented object at a reasonable time, in case of an emergency, repair or other urgent reason, if possible in consultation with the tenant.

The owner has the right to ask the tenant to leave the rented property without any refund if the behavior of the tenant and / or his / her group is disruptive and / or unacceptable by standards of reasonableness and fairness.

The owner reserves the right to refuse entry to anyone who is deemed unsuitable to occupy the rented property.

Number of guests

The maximum number of persons entitled to stay in this property is as stated and confirmed in the reservation. Furthermore, only those with the name on the list are entitled to stay. If it turns out that more persons than agreed are staying in and around the rented property without written permission from the owner, this will be considered a breach of the contract and the tenant and his / her party will be asked to leave the stay immediately without any return of rent or other compensation. Subletting or transferring the lease is prohibited.

Pets

Pets are not allowed in the rented.

Arrival and Departure Time

Every effort will be made to have the house available from 16.00 pm on the day of arrival. The house must be vacated by the tenant no later than 10.00 am on the day of departure. Late delivery will result in a surcharge, unless other arrangements have been made. In consultation it is possible to store luggage in a locked room if your arrival is earlier than 16.00 p.m. or departure later than 10.00 a.m. The owner is present, or has himself represented, to hand over the keys etc.

Liability

The owner is not liable for an accident, theft, loss or damage on his property. Always close your apartment (s) and car (s) well.

Minor children must always be supervised.

Cleaning

We assume that the tenant and his group treat the rented property as their own house and leave it in a normal condition at the end of the holiday. The costs for final cleaning (€ 60 for apartments I and II and € 90 for apartment III) are included in the rent, but only for normal cleaning. The owner reserves the right to charge a cleaning fee if the property is not left in a normal condition.

Break

The tenant will endeavor to keep the house, inventory and all contents in the same condition and condition as at the beginning of the rent. Damage or breakage must be reported to the owner (or his representative) before departure. The owner reserves the right to request compensation for this, noting that minor breakages and normal wear will not be charged.

Complaints

We strive to make your stay with us comfortable and unforgettable. Things can go wrong. In these circumstances, it is the tenant's responsibility to report a problem to the owner (or his representative). Only then is it possible for the owner to try to repair / correct the situation as soon as possible.

Additional costs

The use of electricity (including hot/cold air conditioning) is included in the rental price unless otherwise agreed. This includes rental in the months of November, December, January, February and March. 

Return of the deposit

Your deposit, minus any deductions, will be refunded to you within 7 days of departure.

Long-term rental / wintering

For long-term rental and / or in the case of hibernators, other agreements may have been made between the parties.
